Terms and Conditions

Who Operates This Site

HeatX Inc. This site presents Mueller plate and frame heat exchangers, Temp-Plate embossed panels, falling film chillers and brazed plate units, with reference material on their construction, ratings and applications. Browsing it puts you under the conditions set out below.

These conditions get revised now and again. Whatever is published on this page is what currently stands, and the date at the foot of it shows when that last moved. Carry on using the site after a revision and the revised version is the one that binds you.

Quotations and Orders

A quotation holds for the period stated on it, and is subject to material availability when the order is actually placed. Its price rests on the process conditions, materials, code requirements and documentation written into it; if any of those move after order, price and delivery may move with them.

An order is accepted on these conditions. Should a purchase order carry terms that pull against them, those terms bite only to the extent we have said in writing that they do.

How a Selection Is Made and What It Promises

Equipment is selected against the process conditions you give us. Where something is missing we will state the assumption we used, and that assumption forms part of the basis of the selection rather than sitting outside it.

Performance is committed at the stated design conditions. Operation away from them — different flows, temperatures, pressures, fluid compositions, or fouling past the allowance agreed — sits outside that commitment.

How Far the Information Here Goes

Dimensions, ratings, materials and application notes are published in good faith, as general reference and nothing more. Product lines move on, and the unit standing in your plant may well have been built to a specification since superseded.

None of it stands in for a written quotation or for the data report that shipped with a particular unit. If you are going to design around a figure, ask us to confirm that figure first.

Who Decides What the Code Requires

Not us. Whether a duty needs double-wall plates for potable service, an ASME stamp, registration with the National Board, or a CRN for a Canadian province, that comes from the jurisdiction the unit is going into and from the authority having jurisdiction there. Our part is to say what can be supplied and then supply what is ordered. Working out which of those requirements bites on your installation remains the purchaser's.

Delivery

Delivery dates are estimates made in good faith on the conditions existing at order acknowledgement. Where a jurisdictional registration is needed and the model is not already registered where the unit is going, the registering authority's timescale is outside our control and outside any delivery commitment we give. Delivery terms, and the point at which risk passes, are as set out on the acknowledgement.

Intellectual Property

Copyright in the words, photographs, diagrams and layout of this site is ours, or is held by someone who has let us use them. Read them and print them while you are evaluating or specifying equipment — that is what they are here for. Putting them out again anywhere else, for any other reason, needs our permission in writing.

Mueller, and other manufacturers' names and marks appearing here, remain the property of their respective owners.

Warranty and Liability

The acknowledgement for your order carries the warranty that applies to it; the warranty page sets out what that normally covers. Beyond what is written there, nothing further is given or implied — including any implied warranty of merchantability, and any implied warranty of fitness for a particular purpose.

What we can be held to stops at the remedies in that warranty. Production you lost, profit you lost, what it cost to pull the unit out and put another one back, and indirect or consequential loss of any kind, however it came about, all sit outside. None of this touches liability the law does not allow to be limited.

Payment and Governing Law

Payment terms are as stated on the order acknowledgement, and title to equipment passes when payment is received in full.

California law governs what is written here. Any dispute that comes out of these conditions, or out of equipment we supplied under them, belongs before the California courts.
